Terms of Service

These Terms of Service ("Terms") govern your use of 1Chat AI and other products ("Services") provided by Evirtux Inc. ("we", "us", "our"). By purchasing, installing, or using our Services, you agree to these Terms.

1. License

Upon purchase, we grant you a non-exclusive, non-transferable license to use the software on the number of devices specified by your plan:

License keys are for personal or business use and may not be resold, shared publicly, or distributed.

2. Free Features

Translation features are free and available without a license. Free features may be modified or limited at our discretion.

3. AI Features & API Keys

AI features require you to provide your own API keys from third-party providers (OpenAI, Anthropic, Google, Groq, DeepSeek). We do not provide AI API access. You are responsible for your own API usage costs and for complying with each provider's terms of service. API keys are stored locally in your browser and are never transmitted to our servers.

4. Payment & Billing

All payments are processed securely through Stripe (stripe.com). We do not store your credit card information. By making a purchase, you also agree to Stripe's Terms of Service and Privacy Policy.

All prices are in US Dollars (USD). Prices may change at any time, but changes will not affect existing purchases.

5. Refund Policy

Before activation: Full refund available within 7 days of purchase.

After activation: Refund available within 72 hours of activation. After 72 hours, no refunds will be issued.

To request a refund, email support@evirtux.com with your license key and purchase email.

Refunds are processed via Stripe and typically take 5–10 business days to appear on your statement. Upon refund, your license key will be deactivated immediately.

The Services are provided "as is" without warranty of any kind, express or implied. We do not guarantee uninterrupted or error-free operation. We are not responsible for any data loss, third-party API failures, or WhatsApp policy changes that may affect functionality.

8. Limitation of Liability

To the maximum extent permitted by law, Evirtux Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services. Our total liability shall not exceed the amount you paid for the license.

9. Updates & Changes

We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance. We will notify users of significant changes via our website or email.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of Texas.
